Heat overcome Rondo, top Boston 115-111 in Game 2

(AP) ? Rajon Rondo posted a stat line never before seen in NBA playoff history. He was on the court for every second of a game that finished more than three hours after it started. He scored more points in a single overtime than anyone this season.

His night was called incredible, amazing and unbelievable ? and that was by the Miami Heat.

And when it was over, Rondo could only express disappointment that the Boston Celtics needed more.

LeBron James scored 34 points and grabbed 10 rebounds, Dwyane Wade scored eight of his 23 points in overtime and the Heat took a 2-0 lead in the Eastern Conference finals with a 115-111 win over the Celtics on Wednesday night, overcoming what will surely go down as the best game of Rondo's career to move within six wins of an NBA title.

"We lost," Rondo said, shrugging off talk of the historical ramifications of his night. "Simple as that."

Rondo's final numbers: 44 points, 10 assists, eight rebounds. He scored all 12 of Boston's overtime points, giving the Celtics the lead three times, only to have the Heat answer each of those. And when he finally missed in the extra session ? on a play where Rondo said he got struck in the face by Wade ? then and only then could Miami put Boston away.

Game 3 is Friday night in Boston, where the Celtics will try to make this a series. No Celtics team has successfully rallied from an 0-2 hole since 1969.

"He really played his heart out and carried the load for us offensively," Celtics forward Paul Pierce said. "He shot the ball, did everything possible you could ask for in him. You just hate to see an effort like that really go to waste."

Mario Chalmers scored 22 points for Miami, which got 13 points, 11 rebounds and three assists off the bench from Udonis Haslem. The entire Celtics bench combined for seven points, five rebounds and one assist.

Miami trailed by 15 points in the first half, making this the largest deficit the Heat have overcome to win a playoff game in their history. Miami had rallied from 14 points down to win twice before in the postseason, one of those being the game that clinched the 2006 NBA title.

"There just can't be any other way with this team," Heat coach Erik Spoelstra said. "And it has to be the hard way."

The Heat won on a night where so many things ? Rondo's effort included ? suggested that they were in going to be in trouble.

There was the big early deficit, a 7-for-20 shooting effort from the floor by James, Wade going scoreless until the final seconds of the first half, 16 missed free throws and two missed chances to win ? both shots by James ? at the end of regulation.

And if all that wasn't enough, Boston's Big Four were Big again. Pierce scored 21 points before fouling out. Kevin Garnett scored 18 points and added eight rebounds. Ray Allen, ailing right ankle and all, went through two gameday shooting workouts to try to snap out of a slump and apparently did, finishing with 13 points, the last three of those coming on a 3-pointer that tied the game at 99-all with 34.3 seconds left in regulation.

Miami managed to survive it all. Haslem's dunk with 1:28 left in overtime to put Miami on top for good, Wade had a three-point play with 59.7 seconds left, and the Heat won their sixth straight East finals game going back to last season.

"One of the best games I've played in, win or lose," Heat forward Shane Battier said. "It's easier said when you win ? but it's unbelievable."

Miami was down by as many as 11 in the third quarter, before a pair of 3-pointers by James started a comeback. Wade made consecutive jumpers midway through the third to shake off a slow start to his night, and the 2006 NBA finals MVP set up Haslem for a three-point play that gave Miami its first lead since the opening minutes, 73-71.

As Haslem's shot dropped, Wade spun at midcourt and punched the air. More highlights followed.

Miami's lead reached seven points in the third after James blocked Pierce's shot near the rim, sending the ball high into the air and starting a sequence that was capped by a three-point play from Wade, pushing the margin to 78-71. It capped a 12-0 run for the Heat, who took an 81-75 lead into the fourth.

James stole the ball from Rondo early in the fourth, drove down the court and got wrapped up by Mickael Pietrus, who was assessed a clear-path foul, meaning Miami got two free throws and the ball. James missed both foul shots, Mike Miller missed a 3-pointer later in the possession, and the lead stayed at 85-81.

Barely a minute later, it was gone. Pietrus hit a 3-pointer, Rondo followed with a steal and layup and Boston led 86-85. The margin was out to five with 3:50 left after a jumper by Pierce, and the Celtics looked to be in control.

"We never felt like we were out of it," Wade said.

They were right. A 9-0 run gave Miami the lead back, before Allen's 3 tied the game. James missed a layup with 21 seconds left, but got his own rebound and extended the possession. He tried a jumper with 2 seconds left to win it, the shot missed, and the teams went to overtime, where the reigning MVP missed two more free throws to start the extra period.

"LeBron James took 24 free throws tonight," Celtics coach Doc Rivers said. "And our team took 29."

Miami finished 31 of 47 from the line, Boston was 26 of 29. The Celtics were called for 33 personal fouls, Miami 18.

Rondo nearly rendered all those talking points moot. He was 4 for 5 from the floor in overtime, but with Pierce having fouled out and Garnett and Allen having combined to play over 80 minutes at that point, it seemed like Rondo was going 1-on-5.

He almost pulled it off.

"Rondo was absolutely amazing," James said. "The performance he put on tonight will go down in the record books."

NOTES: It's the 10th time Miami has taken a 2-0 series lead. The Heat prevailed in each of the previous nine. ... Haslem had his first postseason double-double since 2009. ... Wade played in his 100th playoff game. ... Celtics F Greg Stiemsma had four fouls in the first quarter, the first NBA player to do that since 2009. ... Rondo had 22 points in the first half for just the second time in his career. He also did it Feb. 22, 2009 at Phoenix.

After the rather vague teaser from three days ago, ASUS is back with two new videos to highlight its surprises at Computex next week. The first one comes with the tag line "All-in-one is no longer in one," with the money shot being the Windows 8 logo and the Android mascot showing up on two water droplets after they separated. This dual-OS and possibly dual-body concept reminds us of the Lenovo IdeaPad U1 Hybrid that never really materialized on the market (at the time of publishing this article, Lenovo's product page still embarrassingly says "This laptop is not available to purchase yet"), so we certainly hope ASUS won't fall into the same pit with its upcoming mysterious product.

The second teaser, titled "When two sides unite," features a suspended cardboard with "Tai" printed on the left of the white side, and "Chi" on the right of the black side. After a finger smears a dot of paint on the "i" on both sides, the cardboard starts spinning to show a flickering image of "Tai Chi." Our money's on a laptop with a dual-side touchscreen on the lid (the smearing being the hint for touch input), thus saving the need of extra mechanical parts to make a convertible device (and out goes the Eee Pad Slider). Ultimately it depends on whether the cost of such double-sided displays like LG's would be feasible for ASUS to realize this idea; or worse yet, this could be just a matter of slapping two display panels back to back à la Samsung SCH-W999, which might not make sense when you take both weight and cost into consideration. Well, we shall find out the truth in a few days. Check out the video clips after the break.

If you hire your kids, be the boss, not the parent ? Business ...

It?s almost summer, and some lucky kids will be working in their families? businesses. Sole proprietors and partnerships where both spouses are partners can get some special payroll tax breaks for hiring their kids.

But those businesses also start with two strikes against them, since the IRS is likely to presume that payments made to kids are nondeductible allowances, not deductible wages. Family businesses that are organized as corporations can?t reap similar tax breaks, since kids go on the corporate payroll, but the same wages-or-allowance pitfall remains.

Regardless of your business structure, following a few rules can keep the IRS out of your hair this summer.

Rule #1?Make sure it?s legit. The boss?s daughter must be treated like any other employee. She must have real job duties, file a real W-4, submit real time sheets, etc. Having the ?employee? not show up at all, or perform basic household chores while on the company payroll, won?t pass muster with the IRS. Why: The company had no intent to pay compensation.

Rule #2?Base pay on the services performed. There is no room for flexibility when it comes to paying your child. The IRS will consider it suspect if a dependent is paid a flat amount that?s determined at the beginning of the year. Don?t, for example, calculate what you can afford to pay your son even before he gets out of school for the semester.

Another no-no: calculating pay to exactly equal the year?s standard deduction. You can call it a wage advance, but the IRS will call it an allowance. In all likelihood, a court will call it an allowance, too. Pay should be in line with what other employees with comparable duties receive.

Similarly, the dates of payment should correlate with the dates services are provided. Don?t pay your daughter the bulk of her wages either before she starts work for the summer or after she leaves for school in the fall. ?Likewise, don?t pay off her credit card bills and call it a payment of wages. Again, that looks an awful lot like an allowance. She?s on the payroll, along with other em??ployees, so she should be paid with them, too.

Rule #3?Respect the payroll rules. Every child on the payroll gets a W-2 at the end of the year, like every other employee. Federal income tax withholding always applies (unless the child elects an exemption from income tax withholding), but state tax law may exempt the child from income tax withholding.

The special payroll tax benefits for sole proprietorships and spousal partnerships, which the IRS recently restored, come into play here. Whether these businesses must ?withhold and pay FICA and pay FUTA, depends on dependents? ages.

  • Payments to dependents under the age of 18 are FICA and FUTA free.
  • Payments to dependents under the age of 21 are FUTA free.

Foursquare (for PlayStation Vita)


Even if you've never used Foursquare, you've probably heard of the location-based social networking service which lets users check into restaurants, clubs, and other venues and businesses for discounts or simple bragging rights. Foursquare makes the jump from desktops and smart phones to the PlayStation Vita ($299, 4 stars)?as one of the most well-rounded apps in Sony's marketplace. In fact, Foursquare for PS Vita packs just about every feature found in the smart phone versions. It's a free app, has a useful recommendation engine, and lets you connect other social networks to share your check-ins. In short, if you're one to explore your town's scene, and like the idea of sharing your thoughts about it with others, this is your app. Note: If you live in a non-urban area, the app may not be as useful due to the lack of venues at which you can check in?a limitation that applies to all versions of Foursquare.

Getting Started
You begin by logging in with an existing Foursquare account or creating one from within the app. The app brings you to the home screen, which has tabs for Friends, Check In, Explore, To-Do, and Me at the top?it's very similar to the mobile phone versions. Most of the tabs are self-explanatory, but a few require explanation if you aren't familiar with the service. "Explore," for example, offers recommendations for popular and much-discussed locations, thus making it a valuable tool for discovering new places to visit in your area. I know of a few extra lunch options thanks to my testing of Foursquare.

"Me" is your personal profile. It displays your total number of check-ins, the last check-in location, badges and mayorships earned (rewards earned for checking in on a consistent basis), and other information. The PS Vita's camera comes into play here as you can snap a photo of yourself to use as a profile picture. The PS Vita doesn't pack the best imaging hardware, so you may want to bathe yourself in light as you snap the photo.

Checking In
Like the mobile phone versions, you check in by tapping "Check In," conducting a location search, bringing a finger to the Check In icon, and crafting a message. For example, I keyed PCMag into the search engine, which I highlighted, and then checked into by tapping the Check In icon. I also uploaded a snapped photo (you can use either the PS Vita's front- or rear-facing camera), which I thought was a nice way to add the personal touch to check-ins. Speaking of the personal touch, you can add helpful tips to Foursquare such as "The deep fried Oreos are to die for!" and other users will see them when they look up information about the venue or business.

The To-Do area is where saved tips live. The Foursquare smart phone mobile apps lets you save both tips and/or the venue itself, but the PS Vita app limits you to just tips. It's not a big loss, but I would like to have the same options as smart phone users.

You can opt to share check-ins with your Foursquare friends, and to your Facebook and Twitter social networks (unfortunately, you can only connect those external services using a Web browser). That said, if you're an avid updater who cares about your followers' mental well-being, you may want to leave these settings deactivated to avoid flooding their streams. You can search for friends by name, Facebook ID, Twitter handle, email, and phone number.

There's also a scoring system which rewards points for various actions, such as checking in to a place for the first time or checking in as a group. The points are tallied on a leaderboard where you can see where you rank among your Foursquare friends.

Preferences lets you set the distance units (imperial or metric), add friends, see friend requests, logout, and more. You can't, however, toggle all privacy options within the app. Earning mayorships and being included in a list of people who are checked in at a venue requires you to visit the Foursquare website.

It's Hip to Be Square
All these features add up to an app that you'll use often. I was an admitted Foursquare non-believer before reviewing?the idea of broadcasting my location to the world didn't appeal to me in the least?but I now understand why the service is so popular. It dangles just enough achievements and freebies to keep you checking in. Thanks to its ease of use, rewards, and venue discovery features Foursquare is easily the best PS Vita app available, and it wins a PCMag.com Editor's Choice.

Storm Chances for North Texas Next Two Nights, Then Cooler Weather!

There is a Slight Risk Outlook for severe weather this evening and overnight. Our chances for storms don?t look as good as they did last night, but we will have to watch storms that develop along the dryline to our west and the stationary?front to our north. Storms that develop in Oklahoma could dive SE toward North Texas tonight. Areas NE of Dallas (i.e. Paris, Sulphur Springs, Bonham) have a slightly better chance of seeing the Oklahoma storms move in after sunset into the night. But for Dallas/Fort Worth, there is a slight chance of storms this evening and overnight, but overall doesn?t look like last night. We, of course, will have to wait and see what bubbles up this afternoon to our north and west. That will determine what happens later tonight. Be sure to get the latest on CBS 11 News at 4, 5 and 6.

An eBook Standards Carol Part 1: Ghosts of Formats Past | Shaggin ...

Hey folks, brace yourselves for a lot of information about the eBook format wars; I?m going to switch hats for the next two posts and write as a technical writer rather than a novelist. I?ll get back to the ghosts and goblins soon, I promise.?This post began with a two-part post over at A List Apart about the state of standardization in the current eBook market and where it might be going, including the need for a standard format that everyone can use. You can read Part One here and Part Two here, then come on back.

I shared the post with JW Manus, as she?s explored quite a bit with formatting eBooks and even taught me some tricks that I didn?t know. I was interested in seeing her take on it (and she is sharing her thoughts in tandem with my own here ? we?re going for complimentary posts here, so please read hers, too, it?s a worthwhile read), but we ended up in a discussion and I realized that I, too, actually have some things to say about the current state of eBooks and format standardization. Here is the drive of my argument, cleaned up just a bit:

?I?ve come to realize that I?m fortunate in some ways, as I?ve been fighting the formatting wars for close to 13 years when creating documentation (I?ve become a style sheet wizard, which helps in HTML transformations, but that?s a hard-fought victory). Standards can definitely be a double-edged sword. Implementation is everything ? MS Word, for example, has some standards, but the implementation is incredibly sloppy. Anyway?he?s right in that we?re becoming a bit more platform agnostic, but everything seems so very patchwork. The most reliable application that I have found for converting Kindle files is an antiquated command-line application. We have to use the ridiculous workarounds that come with translating legacy file formats, and the future is just more of those workarounds if we continue down the same path of everybody following their own paths. This line, in particular, echoes something I?ve written on my blog: ?The publishing landscape of 2012 looks similar to the music landscape of 1998, crossed with the web designs of 1996: it?s encumbered by DRM and proprietary formats, it treats customers as criminals, it?s fragmented across platforms, and it?s hostile to authors who want to distribute their work through independent channels.??

Essentially, I realized that I had lived through so much of the period described above that I should talk some about what that was like, and what I learned. Here?s a bit of my own journey, and how I see things eventually playing out, from the standpoint of a technical writer.

My career journey began in 1995, when I acquired a steady point of access to the Internet via my University?s connection. Sure, I had been on before, using a patchwork combination of friends? Prodigy and AOL accounts (the latter kind of not really qualifying but a mindblowing deal at the time). This was the REAL wild west of the Internet: our browsers didn?t have images unless they were running on high-powered computers, which you almost never saw; our chat was IRC, and while it could be simple to use, it was also very flexible and allowed you to do incredible things ? for yourself or to others; and the quickest way to send files was a shared FTP site. Having your photo online was unthinkable. You get the picture.

I started learning rudimentary HTML at the time, though pretty much all HTML was rudimentary. So few people were creating their websites ?and there were so few browser options that things were opened wide up. Remember, Internet Explorer wouldn?t even debut until the end of the year ?- as if we would ever use that. Your options were either the text-based Lynx, Netscape (formerly Mozilla), Omniweb, and Grail. I only heard of the latter, but never saw them. HTML as a standard was still fairly new, and didn?t have anywhere near the features that it would support in ten years, so you were pretty safe writing a web site in a certain way; browsers would handle HTML in the same fashion. My original site is long-gone, or I would show what I?m talking about. What you need to know is that it was fairly straightforward: these tags did that, and you?re ahead of most of the game if you can italicize words or indent.

Internet Explorer 1.

Internet Explorer is pretty much where that started to go off the rails. This is probably a familiar pattern to most folks ? open standard is established, big company comes along and bastardizes the format into a proprietary format that enables said company to corner a part of the market. Microsoft was bad about this, but are far from the only culprits. Suddenly your HTML might not look the same in Internet Explorer as in Netscape. You had to start customizing your code for certain browsers. You other Internet graybeards will no doubt remember this, along with the ?Optimized for Netscape? disclaimers on sites:

I think you can probably see where I?m going here. The fragmentation just got worse and worse over the years, as new browsers came and went and different companies dug in their heels. Yes, HTML was supposed to be an international standard, but no one could really enforce this. So too, today do we have a myriad of different major eBook formats. Most draw on HTML, but have their own implementations and interpretations of the tags. Here?s just a sampling, though I?m sure you?re familiar with most:

  • ePub
  • eReader (pdb)
  • HTML (yes there are still eBooks that are pure HTML)
  • Kindle (.azw and .kf8, also works with MOBI)
  • Mobipocket (MOBI)
  • Microsoft .lit (LIT)
  • Acrobat (PDF)

And so on. You get the idea. Loads of different formats out there, and no one ?ring to rule them all?. These each have their own advantages and drawbacks, which I?ll talk about in the next post. For now, I think you might have a picture of where the web and HTML lie around the turn of the century: the whole thing was a mess (and we haven?t even talked about things like VRML, Java, or SGML, but we?ll get there soon). The World Wide Web Consortium (W3C), the international standards organization that governs?well, web standards, saw the need to move the web forward with new features but also an increasing need to have everyone speaking the same language.

Enter XML. We?ll talk some about that in the next entry.

'Flaunting it': Gay bar bans straight bachelorette parties

The Abbey nightclub in West Hollywood, Calif., regularly welcomes customers who are not gay, but operators say they will ban straight bachelorette parties until same-sex marriage is legal across the land. KNBC-TV's Angie Crouch reports.

The Abbey nightclub in West Hollywood, Calif.,?regularly welcomes customers who are not gay. But operators say there will be an exception to that policy until same-sex marriage is legal across the land.

?We love our straight girlfriends coming in to celebrate one of the happiest days of their life," says Abbey owner David Cooley. "But it?s also a slap in the face to my customers and my life that we can?t have that same celebration.?

Male go-go dancers are just one reason why one of America's most popular gay bars has become a big draw for straight women's bachelorette parties.


Each weekend, The Abbey hosts several dozen ladies night parties. But Cooley says, no more. Until marriage is legal for everyone, straight women can no longer celebrate their pending nuptials at his club.

His position is getting mixed reviews from both gay and straight customers.

?Everyone should be able to get married," says Roshanna Sabaratnam. "We shouldn?t, as straight people, be flaunting it in front of people who can?t.?

But, there are also some gay customers who disagree.

?I think the ban is an interesting approach to the debate about gay marriage," says Alexander Villalobos. "But I think you shouldn?t limit other people?s rights in order to get yours.?

Factors behind past lemur species extinctions put surviving species in 'ecological retreat'

ScienceDaily (May 23, 2012) ? New research on the long-term impact of species extinctions suggests that the disappearance of one species does not necessarily allow remaining competitor species to thrive by filling now-empty niches.

Instead, in University of Cincinnati-led research on lemur extinctions over the past 2,000 years, findings suggest that one likely result of changes that lead to species' extinctions is that remaining species go into "ecological retreat." And that retreat can result in new selective and ecological pressures that then increase the extinction risk of surviving species, potentially creating an "extinction cascade."

These conclusions are found in the Proceedings of the Royal Society B, in an article titled "Extinction and Ecological Retreat in a Community of Primates" by lead author Brooke Crowley, assistant professor of anthropology and geology at UC.

Co-authors are Laurie Godfrey, professor of anthropology at the University of Massachusetts at Amherst; Thomas Guilderson, research scientist, and Paula Zermeno, scientific associate, both of the Lawrence Livermore National Laboratory; Paul Koch, professor of earth & planetary sciences at the University of California at Santa Cruz, and Nathaniel Dominy, associate professor of anthropology at Dartmouth College.

Using radiocarbon and isotope analysis from fossils of eight large-bodied lemur species that have died out in Madagascar since the arrival of humans to the island 2,000 years ago, the research team was able to determine the type of habitat in which lemurs in the past lived, their diets, when they died out and whether other still-extant species filled vacated environmental niches.

Findings show that prior to extensive human disturbance, lemurs were very common in open habitats of wooded savannah and spiny thicket on Madagascar, which constitutes the majority of southwestern Madagascar today.

But after the larger-sized lemurs that once inhabited those regions went extinct, related species -- that existed then and are still extant today -- could not fill the empty niches. Instead, still-extant lemur species have shown, over time, an increasing reliance on habitats with dense forest cover.

Said UC's Crowley, "The reasons behind the increased reliance on densely forested habitats are uncertain, but it's likely that low hunting and logging pressures in forest reserves are contributing factors."

She added that while forested areas have experienced human disturbance, even greater disturbance has been documented in the unprotected open, drier areas where lemur species once flourished but have gone extinct.

According to UMass' Godfrey, it's not that lemur species of the past two millennia did not live in forested areas at all nor that today's species live only in forested areas. Rather, lemur species were once very common in other, drier and more open habitats in Madagascar and so, species were not so heavily reliant on forest habitat as they are today.

Added UC's Crowley, "It's been assumed that lemurs were in the forests because that's where the resources that best suited them were. Our fossil analysis shows that lemur species once preferred a much wider, more distinctive habitat range, which may mean that modern lemurs prefer the densely forested areas simply because these areas offer greater protection. The forest is more of a refuge."

If so, this could help explain other researchers' previously reported findings regarding "mismatches" between lemur anatomy and observed behavior of modern lemurs in the dense forest environments.

And such mismatches could be indications that today's lemurs are in ecological retreat and at risk if conservation and environmental management efforts don't take into account what were once, and may likely still be, their preferred habitats.

"In other words," explained Crowley, "We now have long-term historical data, a broadened historical perspective indicating that what lemurs are doing today -- preferring densely forested areas -- is not representative of their ecological niche over past millennia. That's an indication that we need to rethink our assumptions on their current habitat choices and on our own conservation efforts. And this form of historically informed research can also be applied to other locales and animals to benefit threatened species."

This research was funded by the David and Lucille Packard Foundation and the University of California Laboratory Fee Research Programme, with additional support from D.A. Burney, University of California. Significant laboratory work for this research was conducted at the University of California-Santa Cruz and Lawrence Livermore National Laboratory.

White House: Apps for key government services coming within a year

With more of us relying?on our phones and the hundreds of?thousands of apps available to help manage our lives, the Obama administration Wednesday issued a directive to?every federal agency to make "two key government services the American people depend on available on mobile phones?within the next 12 months."

"Americans deserve a government that works for them anytime, anywhere, and on any device," said President Barack Obama in a statement.?

The plan is part of a larger effort announced Wednesday to make "large amounts of government data more easily accessible to the public to spur entrepreneurs to develop innovative new services and mobile applications that take advantage of this data, creating new opportunities, businesses and jobs in the process. These actions are part of a larger digital strategy being implemented by the Administration?? a roadmap that will guide the Federal government as it makes the most of new sources of digital information."?

"Mobile is rapidly becoming the platform of choice for Americans; it is now anticipated that by 2015 more people will be accessing the Internet via mobile phones than via traditional desktop computer," the White House said in a?statement. "By next spring, the American people will be able to access dozens of additional government services on their mobile phones for the first time."

There are hundreds of federal agencies, so the task will be formidable.?In the?directive, the administration points to some successful examples already done by cities around the country, including San Francisco.

The City of San Francisco releases its raw public transportation data on train routes, schedules, and to-the-minute location updates directly to the public through web services This has enabled citizen developers to write over 10 different mobile applications to help the public navigate San Francisco?s public transit systems???more services than the city could provide if it focused on presentation development rather than opening the data publicly through web services.

Part of the directive calls for launching a "shared mobile application development program, in conjunction with the Federal CIO Council, that will help agencies develop secure, device-agnostic mobile applications, provide a development test environment to streamline app delivery, foster code-sharing, and validate official government applications."

U.S. Chief Information Officer?Steven VanRoekel said, in a statement, that it is "critical that the federal government keep up with the way the American people do business. Already, families can use government apps to check the wait time at the airport, get access to critical veteran services, and check the status of their tax return. Today?s directive will accelerate our drive to make key services easily accessible to more Americans than ever."

Apps are indeed becoming more relevant in some ways than the Internet; the mobile programs are how more and more of us are getting information, according to a recent report from the Pew Research Center?Internet & American Life Project and The Imagining the Internet Center at Elon University.

While the government effort is ambitious, security concerns ? a growing issue with mobile phones that have increasingly sophisticated operating systems???are noted in the directive, called "Digital Government: Building a 21st Century Platform to Better Serve the American People":

The rate of change of mobile operating systems, new update and notification capabilities from external hardware and software vendors, diversity of the devices themselves, and introduction of employee-owned devices (BYOD) also make security in the mobile space more challenging than in a traditional desktop environment and require new approaches to continuously monitor and manage devices and secure the data itself.

Mountain lion killed in downtown Santa Monica, Calif.

LOS ANGELES (AP) ? Police shot and killed a mountain lion that somehow made its way through an urban landscape before it was found early Tuesday in a downtown Santa Monica office building courtyard near an outdoor mall and a blufftop park that offers tourists views of the ocean and the city's famed pier.

Authorities made multiple attempts to try and subdue the young male cat, including use of a tranquilizer and a pepper ball, before killing it, said Capt. Daniel Sforza of the state Fish and Game Department.

The mountain lion was found about 6 a.m. by a janitor in the courtyard near a popular open-air mall, the Third Street Promenade, and just a couple of blocks from the beach. The street that has a preschool, a church and other businesses was cordoned off as a precaution.

"It's not a risk we can take with public safety," said police Lt. Robert Almada.

It wasn't immediately known how the cat ended up in the middle of the city. The National Park Service has been monitoring 22 mountain lions with GPS radio-collars more than two miles away in the Santa Monica Mountains.

A typical home range for mountain lions is around 200 square miles for adult males, said the agency that has been conducting a study since 2002 in the Santa Monica Mountains to determine how urbanization is affecting the large cats.

Sforza said a necropsy will be performed to see if the mountain lion had rabies or any other diseases.

"It's very unusual," Sforza said of finding the mountain lion. "It's just really hard to speculate."

Lorraine Miller, 89, said she was driving to her novels class, part of a college emeritus program for seniors, when she learned the mountain lion was in the building's courtyard where she was supposed to go.

"It seemed at first it was some kind of tall tale," said Miller, who has lived in Santa Monica for more than 40 years. "Then after a while you see all of this action. It was overwhelming."

Mountain lions are one of the most widespread carnivores in the world with a historical range from Alaska to Tierra del Fuego, Chile. Hundreds of mountain lion sightings are reported every year in California, but attacks on humans are rare. Between 1890 and 2007, there have only been 16 attacks in the state, according to Fish and Game statistics.

Miller said she believes killing the mountain lion was the right, but unfortunate, option.

"In my opinion they were taking care of the public," Miller said. "Frankly you can't object to being taken care of."

In the 2011 case of Smith v. Home Loan Funding, Inc., the Second District Court of Appeals held that a mortgage lender, who represented that they would comparison shop for the best loan, stepped into the role of a mortgage broker, and thus owed the borrower a fiduciary duty.

Mortgage lenders generally do not owe a fiduciary duty to a borrower.? However, in considering the facts and evidence presented in the Smith case, the Court held that the lender undertook a fiduciary duty to the borrower and was eventually held liable for damages.

The case involved a loan that was placed by Home Loan Funding (HLF).? According to the Court?s opinion, ?Anthony Baden worked for HLF as a loan officer.? He had no real estate or mortgage broker license.? In March 2006, Tonya Smith contacted Baden in response to an advertisement she received from HLF.? She sought a $40,000 home equity line of credit.?

The most significant factor in the Court?s decision was that the lender told the borrower he could ?shop the loan.?? When asked whether the lender ever told the borrower that he was a mortgage broker, the lender replied, ?I believe so, yes.?? The borrower testified that she trusted the lender completely and believed he would provide her with the best loan.

The Court determined that the lender, by making such representations to the borrower, acted as a mortgage broker and had, therefore, assumed fiduciary duties to Smith, which HLF breached.? The Court of Appeal affirmed the trial court?s decision, determining there was sufficient evidence to find that the lender?s actions were significant enough to elevate its duties to that of a broker.

Somewhat surprisingly, the Court also awarded plaintiffs their attorney fees.? The Court of Appeal affirmed an award of attorney?s fees to the borrower based on a clause in the promissory note secured by the deed of trust.? This was despite that the lawsuit dealt with the alleged tortious conduct of the lender (breach of fiduciary duty and misrepresentation), not breach of contract. ?This part of the decision has raised eyebrows and sparked controversy as it seems to contradict common logic and appears to be more of a punishment to the lender than a sound legal decision. ??It will be interesting to see what comes of this ruling in the future.

Lone bomber, not mafia, sought for Italy school attack

BRINDISI (Reuters) - A bomb attack which killed a teenage girl and wounded 10 others in southern Italy was probably carried out by a lone individual, a senior official said on Sunday, playing down initial suspicions of mafia involvement.

Saturday's attack on the Francesca Morvillo Falcone school, a vocational training institute named after the wife of a famed anti-mafia judge in the town of Brindisi, horrified Italy and sparked speculation it was the work of organized crime gangs.

However, the Brindisi chief prosecutor in charge of the investigation said it now appeared unlikely that either the Sicilian Mafia or the local version, known as the United Sacred Crown, were involved.

"The most probable hypothesis is that it was an isolated act," Marco Dinapoli told reporters at a news conference held meters away from the site of the blast.

"It seems improbable, not entirely to be excluded, but improbable, that it is connected with mafia networks," he said, adding that attacks on other schools appeared unlikely.

Dinapoli said police already had a facial composite picture of the suspect they believe was behind the attack which killed 16-year-old Melissa Bassi.

Media in Brindisi reported that two men, one a former soldier with knowledge of explosives, had been questioned by police and released. There was no confirmation from prosecutors.

Suspicions of mafia involvement were fed not only by the fact that the school was named after the wife of murdered anti-mafia judge Giovanni Falcone, but also by the timing - the attack took place days before the 20th anniversary of the couple's death in a bomb attack in Sicily.

Thousands took to the streets in demonstrations of sympathy and outrage at the mafia on Saturday but Dinapoli said it was still unclear what had prompted the attack and no claim of responsibility had been received.

He said investigators had acquired "significant" video evidence that suggested one man had set off the device which exploded as pupils were getting off a bus for the start of lessons on Saturday morning.

The footage showed a man of about 50-55 years of age activating a remote control to detonate a rudimentary bomb made of three gas canisters hidden in a container outside the school gates, he said.

"It could be a person who feels at war with the world. It could be someone who wants to create tension for some ideological reason," Dinapoli said.

MONTI HEADS HOME

Prime Minister Mario Monti cut short a visit to the United States to return home to cope with the aftermath of both the attack and an earthquake in northern Italy in which at least six people died.

In Brindisi, a port town on Italy's Adriatic coast where ferries leave for Greece, there was a palpable feeling of shock, with photographs of a smiling Melissa posted around the city and businesses carrying signs declaring they were in mourning.

People placed flowers at police barriers around the 1970s-era school in a nondescript part of town where pupils study fashion, tourism and social services.

Another girl, Veronica Capodieci, has been transferred to a hospital in the larger city of Lecce. She is still in serious condition, but the hospital reported on Sunday that she was stable and had regained consciousness.

The deadly attack on a group of young students was a potent shock for a country already grappling with economic decline and repeated political scandals.

"The school is a symbol of innocence and hope. The moment a school is attacked you have to ask yourself where things are heading," said Franco Scoditti, the mayor of Melissa's home town of Mesagne, near Brindisi.

Italy, which has a history of political and mafia violence, has seen a series of recent attacks on the main tax agency, apparently driven by anger over the economic crisis.

The shooting of the head of nuclear engineering group Ansaldo Nucleare earlier this month added to the tense climate which prompted Interior Minister Anna Maria Cancellieri to step up security at high-risk sites.

With several suicides by struggling small businessmen illustrating the growing impact of Italy's economic crisis, there have been fears of a return to the kind of political violence of the 1970s "Years of Lead" when extreme right and left-wing groups carried out bombings and assassinations.

On Sunday, Pope Benedict added his commiserations to messages of sympathy from leaders including French President Francois Hollande, saying he was praying for "Melissa, the innocent victim of brutal violence and her family".

You yell, you scream, you have angry exchange of words with him. You are still mad, but he has cooled down and he wants to make up by having sex. In your mind, you think, ?Fat chance! How could he behave as if nothing had happened and want to have sex now? Does this mean that we cannot have ?angry sex? or make-up sex? Actually we can and often do.

In a relatively healthy relationship where the occasional argument or even major disagreement is expected, sex life should not be put on hold just because you and your partner cannot agree with each other. Making love is not an admission that you are wrong and he is right. It is an acknowledgment and a celebration of the love you share with him even in times of discord.

For common conflicts such as disputes over household chores, child-care duties, budgeting, in-laws, etc which are no big issues, makeup sex has the power to heal emotional wounds. These ongoing issues may never be satisfactory resolved but good sex can take the edge off them.

Make-up sex is normal and healthy. It can be madly passionate and help to sustain intimacy during tough times. It is natural to feel turned on after an argument. In the heat of an argument, adrenaline and dopamine (a desire hormone) levels rise, giving you the excited feeling. The rush can be a good substitute for foreplay.

While it is not advisable to use passion as a form of escapism, agreeing to sex while still angry may actually be a way to strengthen sexual assertiveness and to encourage us to be more honest and open in our relationships. Partners can become adept at communicating what they really want sexually because the disagreement that sparked the conflict has already lowered their defenses or their sense of inhibition.

It is likely that for a lot of us, make up sex will play some part in our relationships. The sensitive nature of sex should nevertheless encourage us to stick to some principles or strategies for the overall benefit of the relationship. Here are a few to follow and consider.

(1) Never degrade sex

Sex should never be forced on either spouse. It is most important that the wishes of each partner are respected. Sex should never be used to control or manipulate a partner into doing something that he or she does not want to, especially when this difference of opinion is what started the disagreement in the first place. Sex should never be used solely as the solution to a problem. Instead the mood altering properties of lovemaking should be utilized as the gateway for open and honest communication about all those things that have gone wrong in the relationship.

Couples should honestly examine their relationship for repeat-patterns which may hint at some relationship dysfunction. If it always take a blowout to get both of you to connect, then you should seriously consider talking to a relationship counselor.

(2) No personal attacks during arguments

For many couples, an argument is verbal foreplay. They are sexually aroused by the exchange of words. The adrenaline rush that accompanies mild anger creates a response in the brain that is similar to sexual arousal. To use that rush to your advantage, avoid making personal attacks, harsh words and accusations that can worsen the situation. Do not be cruel and mean to each other. Instead, feel the erotic possibilities in the energy pulsing through your angry body.

(3) Have a cool down period

Many angry women need a chill-out period after a fight. Give yourself 15-30 minutes or even an hour alone to take a walk, bath, read or anything that restores your equilibrium. Do not promise sex when the break is over. But if the makeup sex seems like something you are doing for him, you can use this chance to make some special request such as extended foreplay or an erotic massage.

(4) Make it hot and spicy

Some women feel the need to speak their mind before they can move on to lovemaking. Keep it brief. They can use this chance to hone and sharpen their skills of seduction. Give him encouragement with your eyes as you express your feelings. You can start the ball rolling by having some kind of a makeup ritual which can be as simple as taking a shower together or exchanging should rubs.

This can also be used as an occasion to spice things up such as giving him the best blow job he ever had.
