PHOENIX (AP) ? Ron Barber, who almost lost his life in the Arizona shooting rampage that wounded former Rep. Gabrielle Giffords, won a special election to succeed her, giving Democrats a psychological boost after last week's failed effort to recall Wisconsin's Republican governor.

Appearing with Giffords at a Tucson hotel after his victory Tuesday night, Barber told supporters, "Life takes unexpected turns and here we are, thanks to you." Giffords hugged him and kissed his forehead.

Barber defeated Republican Jesse Kelly, who narrowly lost to Giffords in 2010 in a competitive district that Republicans have won in the last two presidential elections. Giffords has made few public appearances since resigning in January to focus on her recovery, but she dashed back to Tucson during the campaign's final days to help her former district director.

Democratic officials were quick to argue that the victory sets the stage for them to win back control of the House.

"This campaign previewed the message fight that will play out across the country in November: Democrats committed to protecting the middle class, Social Security and Medicare versus misleading Republican attacks on Obamacare and national Democrats," said Rep. Steve Israel, D-N.Y., chairman of the Democratic Congressional Campaign Committee.

But Rep. Pete Sessions, R-Texas, the chairman of the National Republican Congressional Committee, said special elections are unique and the Arizona race was particularly so because of what had happened to Giffords. He predicted that Barber would not fare as well in the fall with President Barack Obama leading the ticket.

"No one wanted this election to happen or to see Gabrielle Giffords step down from Congress, but Jesse ran a campaign focused on pro-growth policies that will lead to less government and a strong and vibrant economy," Sessions said.

In his concession speech, Kelly said: "We executed the plan we wanted. The voters of southern Arizona did something different."

Republicans had sought to make the contest a referendum on Obama and his handling of the economy. Democrats played to the senior vote by contending that Kelly would not protect Medicare and Social Security.

With 100 percent of precincts reporting, Barber won about 52 percent of the vote while Kelly had 46 percent.

Both candidates have promised to run for a full term in the fall, setting up a possible November rematch in a redrawn district that is friendlier to Democrats. Republican voters outnumber Democratic voters by about 26,000 under the current map. That edge will narrow to about 2,000 under redistricting.

Elsewhere Tuesday, Virginia, North Dakota, Nevada, Maine, Arkansas and South Carolina held primary elections.

In Virginia, George Allen, a former governor and senator, brushed aside three rivals in the Republican Senate primary. Allen's victory set up a November clash with another former Virginia governor, Democrat Tim Kaine, in a campaign closely tied to the presidential race in a state both parties consider vital for victory.

In North Dakota, Rep. Rick Berg defeated businessman Duane Sand in the state's Republican Senate primary. Berg faces Democrat Heidi Heitkamp in the November race to replace retiring Sen. Kent Conrad. The election is expected to play a critical role in determining which party controls the Senate.

Voters also decided to let the University of North Dakota scrap its controversial nickname, the Fighting Sioux. The NCAA had deemed the name hostile and abusive, and placed the university under postseason sanctions. The state's Board of Education is expected to retire the moniker and American Indian head logo.

In Nevada, Republican Sen. Dean Heller and Democratic Rep. Shelley Berkley easily defeated a slate of political unknowns in their respective primaries. Their fall race will be one of the most competitive in the country.

In Maine, state Sen. Cynthia Dill won the Democratic primary in the race to succeed Republican Sen. Olympia Snowe. Maine Secretary of State Charles Summers won the GOP nomination.

The front-runner, former two-term Gov. Angus King, wasn't on the ballot because he's running as an independent.

No statewide races were part of the Arkansas and South Carolina primaries.

Of all the races Tuesday, the Arizona House race was the most closely watched, partly because of Giffords' absorbing story and partly because holding onto the seat is important for Democrats if they want to regain control of the House.

The party needs big gains in November to grab the majority from Republicans, who now hold a 240-192 advantage with three vacancies, including Giffords' seat.

Republicans, riding high after a decisive victory in Wisconsin's gubernatorial recall election last week, set their sights on Arizona. A victory would have given party leaders a chance to claim momentum five months before November and fine-tune their plan to link Democratic candidates to Obama, the incumbent at the top of the ticket.

Outside groups spent more than $2 million on the race. Barber, 66, had a sizable fundraising lead in late May, but spending from conservative groups helped reduce the Democratic financial edge.

The Arizona 8th is a rare district that is competitive virtually every election. Giffords defeated Kelly by about 4,000 votes in 2010, when the election focused on immigration and when tea partyers rallied to the tough-talking former Marine. Now, the economy and jobs are voters' top concerns.

Democratic officials were thrilled that Barber won a district that President George W. Bush carried with 54 percent of the vote in 2004 and that John McCain carried with 53 percent of the vote when he ran against Obama.

Kelly, 30, spent the campaign arguing that Barber and Obama are out of touch with people in the district. He called for lower taxes and more energy production as ways to improve the economy. And he said he would roll back federal regulations and environmental protections in an effort to boost oil and gas drilling.

David Arquette and Courteney Cox: It's Legally Over!

Efforts to relax pot rules gaining momentum in US

PROVIDENCE, R.I. (AP) ? Catharine Leach is married and has two boys, age 2 and 8. She has a good job with a federal contractor and smokes pot most every day.

While she worries that her public support for marijuana decriminalization and legalization could cost her a job or bring the police to her door, the 30-year-old Warwick resident said she was tired of feeling like a criminal for using a drug that she said is far less harmful than the glass or wine or can of beer enjoyed by so many others after a long day's work. Like others around the nation working to relax penalties for possession of pot, she decided to stop hiding and speak out.

"I'm done being afraid," she said. "People in this country are finally coming around and seeing that putting someone in jail for this doesn't make sense. It's just a changing of the time."

Once consigned to the political fringe, marijuana policy is appearing on legislative agendas around the country thanks to an energized base of supporters and an increasingly open-minded public. Lawmakers from Rhode Island to Colorado are mulling medical marijuana programs, pot dispensaries, decriminalization and even legalization. Seventeen states and the District of Columbia now authorize medical marijuana and 14, including neighboring Connecticut and Massachusetts, have rolled back criminal penalties for possession of small amounts of pot.

Rhode Island is poised to become the 15th state to decriminalize marijuana possession. The state's General Assembly passed legislation last week that would eliminate the threat of big fines or even jail time for the possession of an ounce or less of pot. Instead, adults caught with small amounts of marijuana would face a $150 civil fine. Police would confiscate the marijuana, but the incident would not appear on a person's criminal record.

Minors caught with pot would also have to complete a drug awareness program and community service.

Gov. Lincoln Chafee has said he is inclined to sign the legislation.

One of the bill's sponsors, state Rep. John Edwards of Tiverton, has introduced similar proposals in past years but the idea always sputtered in committee. Each year, though, he got more co-sponsors, and the bill passed the House this year 50-24. The state Senate passed it 28-6.

Some supporters of decriminalization say they'd like to go even further.

"America's 50-year war on drugs has been an abysmal failure," said Rep. John Savage, a retired school principal from East Providence. "Marijuana in this country should be legalized. It should be sold and taxed."

Opponents warned of dire consequences to the new policy.

"What kind of message are we sending to our youth? We are more worried about soda ? for health reasons ? than we are about marijuana," said one opponent, Rhode Island state Rep. John Carnevale a Democrat from Providence.

A survey by Rasmussen last month found that 56 percent of respondents favored legalizing and regulating marijuana. A national Gallup poll last year showed support for legalizing pot had reached 50 percent, up from 46 percent in 2010 and 25 percent in the mid-'90s.

Medical marijuana helped bring marijuana policy into the mainstream back in 1996, when California became the first state to authorize the use of cannabis for medicinal use. Other states followed suit.

"It's now politically viable to talk about these things," said Robert Capecchi, legislative analyst with the Marijuana Policy Project, a Washington, D.C.-based group that supports the reduction or elimination of penalties for medical and recreational pot use. "The public understands that there are substances that are far more harmful ? alcohol, tobacco ? that we regulate. People are realizing just how much money is being wasted on prohibition."

Colorado and Washington state will hold fall referendums on legalizing marijuana. A ballot question on legalization failed in California in 2010.

This month, Connecticut's governor signed legislation to allow medical marijuana there. Last week, New York Gov. Andrew Cuomo proposed cutting the penalty for public possession of small amounts of pot.

Liberal state policies on marijuana have run into conflict with federal prohibition. Federal authorities have shut down more than 40 dispensaries this year in Colorado, even though they complied with state and local law. In Rhode Island, Gov. Lincoln Chafee blocked three dispensaries from opening last year after the state's top federal prosecutor warned they could be prosecuted. Chafee and lawmakers then rewrote the dispensary law to restrict the amount of marijuana dispensaries may have on hand.

Robert DuPont, who served as the nation's drug czar under presidents Richard Nixon and Gerald Ford, said Americans should be wary of a slippery slope to legalization. While marijuana may not cause the life-threatening problems associated with heroin, cocaine or methamphetamine, it's far from harmless.

"It is a major drug of abuse," he said. "People ask me what the most dangerous drug is, and I say marijuana. Other drugs have serious consequences that are easy to recognize. Marijuana saps people's motivation, their direction. It's a drug that makes people stupid and lazy. That's in a way more dangerous."

Authorities: Ind. woman charged with gambling away grandson's college trust fund found in La.

A 73-year-old woman has been found in Louisiana after being charged with stealing and gambling away $97,000 from a trust fund for her grandson's college education, authorities said, but she may never return to Indiana for prosecution.

Edna Sue Pate was wanted in Indiana, where the charges were filed, but authorities there said they would not have her brought there to face the charges. Officials in that state had been ordered to extradite her only if she was found in a surrounding state, which would not include Louisiana.

Messages seeking comment with Lake County, Ind., Magistrate Kathleen Sullivan were not returned Thursday and Friday.

Webster Parish Sheriff Gary Sexton said deputies found Pate at a home in the northern Louisiana town of Minden on Wednesday. Sexton said his agency would arrest Pate if authorities in Indiana decided they wanted to have her taken there for prosecution ? assuming she stayed at the same home in Minden.

"I have no reason to monitor her at this point," Sexton said. "If they wanted her, they just had to tell me (Wednesday) they wanted her. As far as I'm concerned she's a free lady. She can leave. She can go anywhere."

A probable cause affidavit filed last month by Griffith, Ind., police Detective James Sibley says Pate withdrew more than $97,000 from 2004 to 2007 from a trust fund account opened in 2003 under the name of her grandson, Christian Patrick Kenneth Smith.

The documents say Pate was a trustee on the account but did not have consent to use its funds for any purpose other than Smith's post-secondary education. The documents also say Smith was the sole beneficiary.

The court records claim Pate was known to frequent Indiana casinos and had set up a separate account in 2009 from which she made 49 withdrawals totaling more than $6,000 through April 2010, when the account was closed with a "negative balance."

The court records say 30 withdrawals from that account were made from ATMs at two casinos in Indiana. Records from one of the casinos, Majestic Star II in Gary, show Pate lost more than $93,000 during that time period.

Sibley did not return a message left by The Associated Press.

Smith's father, Tom Smith, who is a private investigator in Griffith, said he wasn't surprised by the decision because he knew Lake County authorities would extradite the woman only from surrounding states because of the expense. He said he found out several months ago she was in Louisiana and asked the Lake County prosecutor's office to extradite her.

"I tried to pressure them. I picketed. I did an e-mail campaign to the Lake County Prosecutor's Office," he said. "If I call them I get routed to voice mail."

Smith said he is frustrated by the lack of help from the Lake County officials, saying there was $40,000 left in the account when he sued Pate in 2008.

"If I had gotten any support from the Lake County Sheriff's Department or the probate court to reopen the trust, my son would still have some money," he said. "It's all very frustrating. I've tried for seven years to try to get someone to pay attention to it."

A residential listing for a Pate on Methodist Camp Road was unavailable.

Tom Smith said the civil lawsuit can't proceed until Pate is brought to Lake County.

"I want her to answer for this so other people realize they can't do this. And that's what my son wants," Smith said.
